1. การยอมรับข้อกำหนด

By accessing or using Lerniva's platform and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services. These terms constitute a legally binding agreement between you and Lerniva Co., Ltd.

You represent that you are at least 13 years old and have the legal capacity to enter into this agreement. If you are under 18, you must have parental or guardian consent.

2. คำอธิบายบริการ

Lerniva is an online marketplace platform that connects students with tutors for private lessons. We provide the technology and infrastructure but do not employ tutors or provide educational services directly.

Services include: tutor profiles and search, booking and scheduling, secure payments, messaging, reviews and ratings, and customer support. We reserve the right to modify, suspend, or discontinue any service at any time.

3. บัญชีผู้ใช้และการลงทะเบียน

Account Creation: You must create an account to use most features. You agree to provide accurate, current, and complete information and keep it updated.

Account Security: You are responsible for maintaining the confidentiality of your password and account. You agree to notify us immediately of any unauthorized access.

One Account Per Person: You may not create multiple accounts. Accounts are non-transferable.

4. ความรับผิดชอบของผู้ใช้

• Provide accurate information in your profile
• Treat other users with respect and professionalism
• Comply with all applicable laws and regulations
• Not use the platform for any illegal or unauthorized purpose
• Not interfere with or disrupt the platform's functionality
• Not attempt to gain unauthorized access to accounts or systems
• Report any violations of these terms or inappropriate behavior

5. ข้อกำหนดและภาระผูกพันของติวเตอร์

Qualifications: Tutors must accurately represent their qualifications, experience, and expertise. You must provide valid credentials when requested for verification.

Professional Conduct: Provide quality instruction, be punctual, respect student learning needs, maintain professional boundaries, and protect student privacy.

Platform Fees: You agree to pay the platform referral fee on all completed lessons. The fee is automatically deducted before payout.

Independent Contractor: Tutors are independent contractors, not employees of Lerniva. You are responsible for your own taxes, insurance, and legal obligations.

6. ความรับผิดชอบของนักเรียน

• Arrive on time for scheduled lessons
• Pay for lessons as agreed
• Treat tutors with respect
• Provide honest feedback and reviews
• Cancel lessons according to our cancellation policy
• Not share lesson materials without tutor permission

7. นโยบายการจองและการยกเลิก

Booking Process: Students book lessons through the platform. Bookings are confirmed when payment is processed and tutor accepts.

Cancellation Policy: Free cancellation up to 24 hours before the lesson. Cancellations within 24 hours may incur a 50% fee. Cancellations within 2 hours are non-refundable except for emergencies.

Rescheduling: Both parties can propose rescheduling. Free if done 24+ hours in advance. Mutual agreement required for last-minute changes.

Payment Processing: All payments processed securely through Lerniva. Students pay upfront. Tutors receive payment 2-3 business days after lesson completion.

Fees: Students pay the full lesson price. Tutors receive payout after platform referral fee deduction. Subscription fees apply to premium plans.

Refunds: Issued for valid cancellations, tutor no-shows, or quality issues at our discretion. Processing takes 5-7 business days.

Tax Responsibility: Users are responsible for applicable taxes. Tutors must report income and pay taxes as required by law.

9. ทรัพย์สินทางปัญญา

The Lerniva platform, including all content, features, functionality, trademarks, and intellectual property, is owned by Lerniva Co., Ltd. and protected by copyright, trademark, and other laws.

You retain ownership of content you create (profile information, reviews, materials). By posting, you grant Lerniva a license to use, display, and distribute your content on the platform.

10. กิจกรรมต้องห้าม

• Harassment, abuse, or discriminatory behavior
• Fraudulent activity or misrepresentation
• Circumventing platform fees by conducting transactions outside Lerniva
• Scraping, data mining, or automated data collection
• Posting inappropriate, offensive, or illegal content
• Impersonating others or creating fake profiles
• Spamming or unsolicited marketing
• Violating intellectual property rights

11. การระงับข้อพิพาท

In case of disputes between users, we encourage resolution through direct communication. If unresolved, contact our support team for mediation.

For legal disputes with Lerniva, you agree to first attempt resolution through good faith negotiation. Unresolved disputes shall be settled by arbitration in Bangkok, Thailand under Thai Arbitration Institute rules.

12. ข้อจำกัดความรับผิด

Lerniva provides the platform "as is" without warranties. We do not guarantee tutor quality, lesson outcomes, or platform availability. We are not responsible for tutor-student interactions or lesson content.

To the maximum extent permitted by law, Lerniva shall not be liable for indirect, incidental, consequential damages, or lost profits. Our total liability shall not exceed the fees you paid in the past 12 months.

13. การยกเลิก

You may terminate your account anytime through account settings. We may suspend or terminate accounts for violations of these terms, illegal activity, or at our discretion with or without cause.

Upon termination, scheduled lessons will be honored. Refunds for unused premium subscriptions may be provided at our discretion.

14. กฎหมายที่ใช้บังคับ

These Terms of Service are governed by the laws of the Kingdom of Thailand. Any legal action must be brought in the courts of Bangkok, Thailand.

15. การเปลี่ยนแปลงข้อกำหนด

We may modify these terms at any time. Material changes will be notified via email or platform notice 30 days in advance. Continued use after changes constitutes acceptance.
